Data Protection Information Statement / Requests for consent / (updated 1st April 2008)

Personal Data collected and purposes. In connection with the Loyalty Program, Diesel S.p.A. (hereinafter Diesel) will collect and process, as a data controller, certain personal information relating to the Members. The personal data which are processed by Diesel in connection with Members may include personal data supplied by the Members (i.e. personal details such as your name, surname, home address, country, sex, telephone numbers, date of birth, e-mail address) and data collected when the Members are provided with the Online Service or are otherwise in contact with Diesel (i.e. amount of Diesel product purchased) (hereinafter the Personal Data). The Personal data will be transferred and stored in Diesel's servers located in the United States of America (a data processing agreements has been concluded for this purpose in accordance with EU standard contractual clauses) and processed (by either electronic or non-electronic means) for the purpose of implementing, managing and administering the Loyalty Program, to conduct statistical market research (by the means of anonymous data), and in order to comply with any obligation set forth by the applicable law. In particular, your e-mail address will be used to send you communication keeping you informed about your membership benefits and entitlements.

The express consent to receive marketing and market research communications and to allow Diesel and its affiliated to carry out other marketing and market research analysis on the Personal Data may be given by the Member at the time of enrolment or subsequently. Where consent is given it may be withdrawn by the Member by sending an e-mail to privacy@dieselcult.com.

Communication of Personal Data. For the above said purposes only, Diesel may communicate the Personal Data to entities performing consultancy or advisory activities for its and to its affiliate companies, either in The Netherlands, within the EU and abroad for performing functions on its behalf in connection with the Loyalty Program (such as fulfilling orders, delivering packages, sending postal mail and e-mails, providing marketing assistance, processing credit card payments and providing customer services). Such companies will have access to Personal Data needed to perform these functions (but may not use it for any other purpose), and are required to process the data in accordance with applicable law. Such companies are appointed data processor on behalf of Diesel and will be listed on a update list available by sending an e-mail to privacy@dieselcult.com.

The Personal Data will then be processed only by persons in charge appointed by Diesel, and notably by Diesel's employees (also employed to Diesel's branches and affiliates).

Time of processing. The Personal Data will be processed for a period of time not exceeding the period of membership of the Member and in any event for a period of time not exceeding three months from the date in which a Member has withdrawn from the Program (unless the law requires the Personal Data to be stored for a longer period of time

Cookies. Certain pages of the Diesel's website providing the Online Service may employ an industry-wide technology called "cookies". The "cookies" are small pieces of data that are placed on your hard disk drive when you access a certain part of a website. Cookies help Diesel understand which parts of its websites are the most popular, where Diesel visitors are going, and how much time they spend there in order to help you by customising your internet settings.

The tracking records are performed and maintained in ways that keep the data non-identifiable. For the purpose of surveys we may combine cookies or other data with your answers but we will ensure that this does not affect the anonymity of the results.

If you do not wish to accept cookies, they can be disabled by referring to your browser manufacturer's instructions.

Exercising the right granted by the data protection law. You may, at any time, exercise the rights recognized to you by the law, namely the right to be informed about the existence, content, source, purposes and methods of processing the Personal Data, and the right to obtain updates, rectification, integration and (when allowed by the law) erasure of the Personal Data These rights may be exercised by contacting the data protection officer appointed by Diesel by sending an e-mail to privacy@dieselcult.com

Direct Marketing.

Diesel S.p.A. offers you the opportunity to receive standard information about exclusive gifts, special offers, events, and other news from Diesel and the Diesel group at your e-mail address, home address, mobile phone through sms. The Diesel group consists of Diesel and a number of subsidiary companies. You will not receive direct marketing from companies outside the Diesel group.

You can sign up for direct marketing by ticking the "I expressly agree" box hereafter.

If you would like us to stop sending direct marketing to you, we offer simple ways to  do this without costs at your request. Whenever you receive direct marketing you will be told how to unsubscribe. In addition, you can change your marketing preferences at any time by sending an e-mail to privacy@dieselcult.com.

If you tell us that you do not wish to receive further direct marketing, you will still receive communications keeping you informed about your membership benefits and entitlements.

Personalised Direct Marketing.

Diesel S.p.A. offers you the opportunity to receive personalised commercial information drawn up according to your purchase preferences on the e-store site. Commercial information relates to special offers, previews of new products, promotions organised by Diesel and by other Diesel Group companies. Communications will be sent to your e-mail address and/or your home address and/or your cell phone number by sms.

Data which shall be processed will be furnished directly by you upon making an on-line purchase (personal data for the dispatch of orders) or registered during on-line transactions (purchase details). Diesel requires your consent to collect and process these data, in order to draw up your purchase preferences and habits and send you the personalised direct marketing communications: you can sign up for personalised direct marketing by ticking the "I expressly agree" box hereafter.
